Terms of Service
Please read these terms carefully before using KukaPay. By accessing our services, you agree to be bound by these terms.

Introduction
Welcome to KukaPay! These Terms of Service ("Terms") govern your use of the KukaPay mobile application and website (collectively, the "Service") operated by KukaPay Technologies Limited ("Company", "we", "us", or "our"), a financial technology company registered in Nigeria. KukaPay is not a bank and does not custody your funds — payment processing and custody of funds are provided by Flutterwave, a CBN-licensed Payment Service Provider. By creating an account or using our services, you agree to these Terms in full.
1. Eligibility & Account Registration
To use KukaPay, you must be at least 18 years old or a student enrolled in a recognized Nigerian institution. You agree to provide accurate, current, and complete information during registration and maintain the security of your account credentials. You are responsible for all activities under your account. KukaPay reserves the right to suspend or terminate accounts that violate these terms or engage in suspicious activities.
2. Services & Transactions
KukaPay provides peer-to-peer payments, bill splitting, savings (Ajo), airtime purchases, merchant payments, and event ticketing services. All transactions are processed in Nigerian Naira (NGN). Transaction limits apply based on your verification level. We reserve the right to decline, reverse, or hold transactions suspected of fraud, money laundering, or violation of applicable laws. Transaction fees, where applicable, will be clearly displayed before confirmation.
3. Prohibited Activities
You agree not to use KukaPay for: illegal activities or transactions; money laundering or terrorist financing; fraudulent schemes or scams; purchasing illegal goods or services; circumventing transaction limits; creating multiple accounts; sharing account access with third parties; reverse engineering or hacking our systems; any activity that violates Nigerian financial regulations or CBN guidelines.
4. Fees & Charges
KukaPay strives to keep transactions free or low-cost for students. Current fee structure: Peer-to-peer transfers (Free up to N100,000/month), Airtime & bills (Free), Merchant payments (Free for users, 1.5% for merchants), Bank withdrawals (N25 flat fee), Failed transaction reversals (Free). Fees may be updated with 30 days notice. Premium features may have additional charges clearly communicated before use.
5. Account Suspension & Termination
KukaPay may suspend or terminate your account if you: violate these Terms of Service; engage in fraudulent or suspicious activities; fail identity verification requirements; have a negative balance for extended periods; are subject to legal or regulatory action; request account closure. Upon termination, remaining balances will be refunded to your linked bank account within 30 business days, minus any outstanding fees or disputed amounts.
6. Disputes & Refunds
For transaction disputes, contact our support within 7 days of the transaction. We investigate all claims within 10 business days. Refunds for unauthorized transactions are processed within 5 business days of resolution. User-to-user payment disputes should first be resolved between parties. KukaPay may mediate but is not liable for losses from peer transactions. Chargebacks from linked cards may result in account restrictions.
7. Limitation of Liability
KukaPay provides services "as is" without warranties of any kind. We are not liable for: losses from unauthorized account access due to user negligence; service interruptions or downtime; third-party service failures (banks, networks); losses exceeding the transaction amount in dispute; indirect, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
8. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of KukaPay shall first be resolved through our internal dispute resolution process. If unresolved within 30 days, disputes shall be submitted to arbitration under the Arbitration and Conciliation Act of Nigeria. The arbitration shall be held in Lagos, Nigeria, and conducted in English.
Updates to These Terms
We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use of KukaPay after changes constitutes acceptance of the updated Terms.
